Can my employer withhold my paycheck for any reason?
Generally, no. An employer cannot legally withhold paycheck for money that's earned.
In California, timely payment of wages is critical. And if an employer fails to timely pay you your wages, either wages that are due on a weekly basis, on a monthly basis, or your last paycheck if you've been terminated, then the employer will be likely liable to pay not only the amounts that they owe you, but penalties and attorney's fees as well.
So, if you've missed a paycheck or somebody failed to pay you your paycheck when it was due or upon termination, call an attorney as soon as possible. There are some strict deadlines that apply to recovering money that is owed to you from your employer.
